Refuse carts can be stored outside behind the front line of the residence and not at the curb. They must be moved back to the house on the same day the trash is collected. Carts stored outside and used for trash storage should have closed lids and no trash spilling out. Refer to Title 10 of the Carbondale Revised Code for solid waste collection and storage.
You can park on any private paved driveway or existing gravel driveway, but not on lawns or sidewalks. For planning, zoning and subdivisions policies, refer to Title 15 of the Carbondale Revised Code.
Vehicles should not park on private property or in a City street in a residential area for car repairs unless it’s an emergency situation. Repairs should always be performed in a garage.

Grass and weeds over eight inches in height are a nuisance and are required to be removed by Carbondale Revised Code.
Permits are not required for garage sales; however, the placement of the signs is regulated. Signs should be displayed from private property after obtaining the owner’s permission. Signs mounted on street or traffic signs, utility poles or fire hydrants within the rights-of-way are subject to removal.

Property owners are required to secure a vacant house or structure to prevent unlawful entry. It may be necessary to board up glass windows to prevent damage or vandalism. Sometimes these properties are abandoned, under foreclosure, or in probate court for years and may become unsightly, but may not be considered dangerous. The Chronic Nuisance Ordinance has minimum requirements for exterior property maintenance. A vacant property can be inspected by Building and Neighborhood Services if reported as a concern for a neighborhood.

Bring a copy of your ticket(s) along with proof of valid insurance, registration or driver’s license to the City Attorney’s Office no later than one week prior to court appearance. Do not assume that your ticket was dismissed. It’s important to always follow-up before your scheduled court date to verify that your case was dismissed. If you submit your proof of compliance by email, you will receive a reply email indicating the status of your request. If you have not received verification of your dismissal, you must appear on your court date. If you do not send proof of compliance one week prior to your court date, you may still be eligible for dismissal. However, you must appear in court and bring the required proof. Trying to resolve a traffic ticket or ordinance violation can be confusing and stressful, especially for those who are unfamiliar with the court system. Many people choose to have an attorney represent them to help explain the procedure and make sure their case(s) are resolved fairly. However, the decision to hire an attorney is entirely your own. You may have the right to have an attorney appointed by the court to represent you if you cannot afford one on your own, depending on the type of offense charged. The judge will explain your rights to you when you make your first court appearance.
Attorneys from the City Attorney’s Office are responsible for the prosecution of traffic offenses and ordinance violations issued in Carbondale. Since their duty is to represent Carbondale, they are legally prohibited from giving legal advice to people charged with crimes, including minor traffic offenses. Court dates are set by the judge who presides over City court. The City Attorney cannot change your court date for you. In order to request a new court date, you must file a Motion to Continue with the Circuit Clerk and have the judge grant the motion prior to your scheduled court date.
It is important to be present and on time at all required court dates. If you fail to appear, several things could happen:•In a minor traffic case, the judge could enter a judgment against you, just as if you had plead guilty. You are then responsible for paying the fines assessed.•If you are charged with a misdemeanor or felony, and you fail to make your court appearance, the judge may issue a warrant for your arrest. Any bond you previously posted could be forfeited.

To take advantage of the benefits, an owner or developer of property within the Enterprise Zone must simply obtain a building permit (the fee for which is waived) and a "certificate of eligibility" from the City of Carbondale's Building and Neighborhood Services Division.

The Carbondale Fire Department will provide and install free smoke detector and replace smoke alarm batteries in anyone’s home that they own and occupy in Carbondale who cannot afford to buy one. We strongly encourage our citizens to take advantage of this program.
Install at least one smoke detector in each sleeping area and on every level of your home. Test your smoke and CO detectors monthly and replace batteries at least once a year.
You must have a CO detector installed in your home if you have gas appliances and/or an attached garage. If you only have one carbon monoxide alarm, install it in the hallway near the sleeping area. Make sure you can hear it from every bedroom, so it can wake everyone up if the alarm goes off while you are asleep. Additional alarms on each level of your home provide extra protection. Carbon monoxide weighs about the same as air and distributes evenly throughout a room. A CO alarm will be effective if it’s on the ceiling, near the baseboard or anywhere in between. Do not install a CO alarm right next to a combustion appliance, like a gas or oil furnace. Instead, install the CO alarm at least 15 - 20 feet away from these appliances whenever possible.
Pursuant to Carbondale City Code, it is unlawful to burn refuse, landscape waste or any other combustible material within the City of Carbondale with the exception of recreational fires, established in the following guidelines:
•The fire is intended for pleasure, religious ceremony, cooking or warmth.•The fire should be in the rear yard, unless none exist, then in a side yard behind the front plane of the house. In no instance should the fire ever be located between the structure and the street.•The fire must be no more than three feet in diameter and two feet in height.•The fire must be at least 25 feet from a structure or other combustible material; 15 if in an approved container.•A method of extinguishment must be readily available; i.e. extinguisher, hose, buckets, etc.•The fire must not be objectionable because of excessive smoke or odor.•The fire must be constantly attended at all times.•The fire department may order extinguishment of open fires that create or add to a hazardous or objectionable situation.

The City of Carbondale is a Council-Manager form of government. The legislative body is comprised of the Mayor and six Council members who are elected at-large. The legislative body establishes the policies for the City. Once policies are set by the Mayor and Council, it is the job of the City Manager and his staff to implement these policies as the executive body. The City Manager is selected by the Mayor and Council and is responsible for hiring all of the City department directors.
The Mayor and Council are elected by voters at-large. Elections occur every four years and the Mayor and Council members serve four-year terms. There are no term limits for these elected officials.
The Mayor has several duties as the top elected official for the City of Carbondale. Some of these duties are official and other duties are ceremonial.

The Police Department provides 24-hour service to the community and does not close. Administrative services, such as the Records Section, are open Monday through Friday, 8 a.m. to 4:30 p.m.
The Carbondale Police Department will take fingerprints for job applications, a professional license, or adoptions. There is a $25 fee for this service. We do not take fingerprints for Immigration and Naturalization Services.
The Carbondale Police Department does provide extra patrol/house watch during a limited time for people who are out of town on vacation. You can complete an online form or come to the Police Department and complete a House Watch form before you leave on vacation. Make sure and call the Department at 618-457-3200 upon your return.
When a person has received a traffic ticket or is arrested, they are required to post bail or a bond. This is a surety that the person will come to court. For a traffic ticket, a person can post a $120 cash bond ($150 cash bond for more serious violations), or bail bond card.
The bond for misdemeanors is $150 and a judge must set the bond for felony charges. Some minor traffic offenses require no cash bond, but the violator must promise to appear in circuit court by signing the ticket.
The City of Carbondale is allowed to enact ordinances to cover building codes, traffic offenses, liquor offenses, etc. If a person is arrested for an ordinance offense, they cannot go to jail for that offense. Court Supervision is a finding of the court, which allows a person to plead guilty to a traffic ticket or minor offense and not receive a conviction on his / her driving record or criminal record. It is a form of probation where the person must report to the judge and not commit another offense for a specified period of time. When persons successfully complete Court Supervision, they often have to pay a fine but do not have a mark on their driving or criminal record.

No, the Carbondale Police Department does not open motor vehicles in which people have locked their keys. Many vehicles' locking mechanisms these days are complex and require specially trained people to open them. We suggest you call an insured locksmith or tow truck company for these situations.
We will attempt to open car doors in emergencies. In these cases, we will attempt to unlock the car but may be required to resort to other measures if the situation dictates.

The administrative tow fee is a fee the City of Carbondale Police Department is allowed by State statute to charge for any vehicle that is towed due to certain criminal offenses. View more information about administrative tow fees, including level 1 and level 2 fees.
In order to pay the administrative tow fee, you will need to show a valid driver's license, proof of ownership or an original, notarized release from the owner giving you permission to pick up the vehicle, and proof of valid insurance on the vehicle to the Carbondale Police Department. Once those items are provided, you will be provided a release to take to the tow yard.
The tow companies charge a separate towing and storage fee. That fee is determined by the tow companies and is not affiliated with the Carbondale Police Department. The tow fee is typically approximately $75 and there is an additional storage charge for each day the vehicle is in the tow yard. Up to 30 grams, or about one ounce, of cannabis plant material, edibles totaling no more than 500mg of THC, and five grams of cannabis concentrate products. Non-residents will be able to purchase half of those amounts.
Beginning on January 1, 2020, a Cannabis Cultivation Privilege Tax is imposed by the State of Illinois upon the privilege of cultivating cannabis at the rate of 7% of the gross receipts from the sale of cannabis by a cultivator. This tax rate already exists under current medical cannabis law. As all funds collected under the Cannabis Regulation and Tax Act and under the Compassionate Use of Medical Cannabis Program Act will be deposited into the state's Cannabis Regulation Fund, the 7% cultivation tax that previously only applied to the cultivation of medical cannabis is repealed, effective July 1, 2020 (See 410 ILCS 130/200), and replaced by the same tax that applies to both adult-use and medical cannabis cultivation. All funds received by the Illinois Department of Revenue under the privilege tax shall be paid into the Cannabis Regulation Fund in the state treasury. The Cannabis Cultivation Privilege Tax will be collected in addition to all other occupation or privilege taxes imposed by the State of Illinois or by any municipal corporation or political subdivision (whether the cultivation is for medical or adult-sue purposes).
Only medical cannabis patients will be able to grow plants at home. they are limited to five plants.
No, you will not be able to smoke cannabis in public legally. Consumption in private residences and permitted cannabis consumption lounges will be legal. Local jurisdictions will be able to decide for themselves if they allow dispensaries to let people smoke on-site.
On January 1, existing medical cannabis dispensaries will begin selling to adults until new licenses are approved. Per the law, the state will begin receiving and processing applications for new licenses on January 2, 2020, and dispensary licenses will be issued starting on May 1, 2020. Another round of dispensary licenses will not be issued until after the state completes a disparity and market study of the industry. The second round of licenses must take into account the study's findings.
The law allows for people convicted of possession of under 30 grams prior to legalization to have their records referred to the Prisoner Review Board and Governor Pritzker to pardon. If the pardon is granted, the Illinois Attorney General will move to expunge their records. Those convicted of possession of larger amounts can petition for expungement themselves. Local State's Attorneys can also pursue expungements on a case-by-case basis. Cook County State's Attorney Kim Foxx has stated she supports cannabis legalization in Illinois, and that her office will expunge all misdemeanor cannabis convictions once it becomes legal. She also said the State's Attorney's Office is currently looking at its policy on prosecuting people who have been detained for selling cannabis once it becomes legal in the state.
A unit of local government may enact reasonable zoning ordinances or resolutions not in conflict with the Act or with the Illinois Office of Cannabis Control, Illinois Department of Public Health, Illinois Department of Financial and Professional Regulation, and Illinois Department of Agriculture rules regulating cannabis establishments. A unit of local government may enact ordinances or rules governing the time, place, manner, and number of cannabis establishments, including a minimum distance limitation between cannabis establishments and locations it deems sensitive through the use of special use permits.
A municipality may exert extra-territorial zoning authority in the unincorporated area within one and one-half miles of its corporate limits through the adoption of a comprehensive plan and zoning for that area pursuant to 65 ILCS 5/11-13-1. The municipal ordinances would control that area absent a county zoning ordinance or another municipality with zoning already in place.
Yes. A municipality may regulate and/or allow the on-premises consumption of cannabis at or in a cannabis business establishment within its jurisdiction in a manner consistent with the Act. The Act allows the creation of "cannabis cafes/lounges" at the discretion of the municipality. Cannabis business establishments or other entities authorized or permitted by a municipality to allow on-site consumption shall not be deemed a public place within the meaning of the Smoke-Free Illinois Act.
A dispensing organization may not be located within 1,500 feet of the property line of a preexisting dispensing organization. These distance restrictions are different than those originally imposed by the Illinois Medical Cannabis Program Act. Under the Medical Cannabis Program Act, registered cultivation centers could not locate within 2,500 feet of the property line of a pre-existing public or private preschool or elementary or secondary school or daycare center, daycare home, group daycare home, part-day child care facility or an area zoned for residential use (410 ILCS 130/105(c)) and registered dispensing organizations could not locate within 1,000 feet of the property line of a pre-existing public or private preschool or elementary or secondary school or daycare center, daycare home, group day care home, or part-day child care facility or be located in a house, apartment, condominium, or an area zoned for residential use (410 ILCS 130/13(d)). P.A. 101-0363, which made various amendments to the Medical Cannabis Program Act and became effective on August 8, 2019, and eliminated the distance restrictions for medical cannabis dispensaries registered after July 1, 2019.

The Act provides municipalities with the authority to locally regulate the possession and consumption of cannabis by private citizens in a manner consistent with the Act. Therefore, municipalities may adopt the prohibitions and penalties of the Act into their codes which will give the local governments the ability to enforce and prosecute personal possession and consumption violations through local adjudication or the circuit court.
Yes. A unit of local government may not regulate cannabis-related activities in a manner more restrictive than their regulation by the state under the Act. Home rule preemption applies here. "This subsection is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State." Yes. The Illinois Office of Cannabis Control shall issue licenses for all dispensing organizations. Dispensing organizations are defined by the Act as a facility operated by an organization or business that is licensed by the Illinois Department of Financial and Professional Regulation to acquire cannabis from a cultivation center, craft grower, processing organization, or another dispensary for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia or related supplies under the Act to purchasers or to qualified registered medical cannabis patients and caregivers.
Since licensing is a function of the state under the Act, local governments may only enforce generally applicable business registration requirements for cannabis establishments and conduct inspections of the premises to ensure compliance with local ordinances.

Yes. All licenses expire and are subject to the renewal provisions set forth in the Act. Adult-Use Dispensing Organization Licenses shall expire on March 31 of even-numbered years. Tax Increment Financing (TIF) districts help municipal governments stimulate redevelopment in a designated area. Using this tool, the City can reimburse property owners for certain expenses using the property tax revenue that new development within the district generates. It is important to note that a TIF district is not an additional tax and does not impact zoning.
When a TIF district is established, the current net taxable value (NTV) on each property within the TIF district is set at a “base” value. Funds are generated by the increase in net taxable value of properties located within the district as those parcels are redeveloped. The difference between the “base NTV” and the new NTV, what is referred to as the “increment”, is rebated back to the municipality. This increment, or rebated real estate taxes, can be used to reimburse developers for approved costs, and/or to cover the municipality’s cost of improving the district.
The rebates are reimbursement for eligible project costs and are tied directly to the property tax increment created on the site of their new development. The City and the property owner negotiate the reimbursement rate based on the new improvements they create. This contract continues until the point at which the property owner has been paid the agreed-upon reimbursement, or when the TIF expires, whichever comes first. TIF 2’s expiration date is December 31, 2035.

All projects are required to adhere to the Residential Tax Increment Financing District Architectural Design Standards by complying with at least two (2) design elements for the appropriate category of the work to be done.
For example, if a roof is to be replaced, it must meet the pitch requirements of 5:12 or greater and the materials or color be different than the immediate surrounding homes. If the siding is to be replaced, it must be one of the approved materials of brick, natural or faux stone, cement, wood, or vinyl and also vary in color or materials from immediately surrounding homes.
To get water services turned on you must sign up for service. You can apply online (residential or commercial); come into our office, present a valid driver's license or other US Government issued ID, sign a contract, and pay a deposit.
Each address is billed in a set of routes.Meaning your meter is read and your bill is generated at the same time as your neighbors. Each route has it's own due date. Please contact us at 618-457-3265 for information on your due dates. Bills are due 3 weeks from the date they are issued.

The deposit stays on your account for the entire time your account is active. Once an account is closed the deposit is applied toward the final bill and any remaining amounts due on the account. The rest of the deposit is refunded to you by check to an address we obtain at the time you close your account.
Once you close you account a final reading is obtained from your meter. A final bill is generated in a week to 10 days. A refund check is mailed with the final bill to the address obtained at the time the account is closed.
If your water gets disconnected for non payment you will have to pay the account balance in full plus a re-connection fee of $40. Water services are typically restored the same day.
